1. Agreement to Terms

Welcome to Quizi AI ("App," "Service," "we," "us," or "our"), a learning tool developed by an independent student developer based in India. By accessing or using the Quizi AI website or mobile application, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our Service.

2. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting the new Terms within the App or on our website. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.

3. Service Availability and Monetization

Quizi AI is currently offered free of charge. We do not currently offer any paid features, premium subscriptions, or in-app purchases. However, we reserve the right to introduce such features in the future, at our sole discretion. Any new pricing models or monetization features will be communicated to you, and your continued use of the Service will constitute your acceptance of those new terms.

4. User Accounts

You may create an account to use Quizi AI or continue as a guest. When creating an account, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

• Registered Users: Your account information and generated quiz history are stored and accessible across sessions.
• Guest Users: An auto-generated temporary ID provides access to limited features. Data generated in guest mode is not linked to a persistent profile and will be lost upon logout or session expiration (typically within 15 days).

5. User Conduct and Prohibited Content

You are solely responsible for the content you upload, type, or submit to Quizi AI for quiz generation ("User Content"). You agree not to upload or submit any User Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
• Contains viruses, malware, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• Contains any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
• Misrepresents your identity or affiliation.
• Collects or stores personal data about other users without their express consent.

You also agree not to:

• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service.

Violation of these rules may result in immediate content removal, warnings, temporary suspension, or permanent termination of your account at our sole discretion.

6. Intellectual Property

• Your Uploaded Content: You retain all ownership rights to the original text, images, or PDFs you upload to Quizi AI. By uploading content, you grant Quizi AI a limited, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and process your content solely for the purpose of generating quizzes for you through our Service.
• AI-Generated Quizzes: The quizzes generated by Quizi AI's artificial intelligence models are considered the intellectual property of Quizi AI (as the creator of the tool that produces them). You are granted a personal, non-exclusive, non-transferable license to use these generated quizzes for your personal learning and study purposes. You may share these quizzes for non-commercial educational purposes, but you do not acquire ownership rights to the AI-generated output itself.
• Quizi AI Service: All rights, title, and interest in and to the Quizi AI Service (excluding User Content) are and will remain the exclusive property of Quizi AI and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.

7. Disclaimers and Limitation of Liability

THE QUIZI AI SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE SERVICE.

• AI Accuracy Disclaimer: Quizzes generated by artificial intelligence may contain inaccuracies, errors, or incomplete information. We do not warrant the accuracy, completeness, or reliability of any AI-generated quiz content. You are strongly advised to verify any information provided by the AI-generated quizzes with reliable sources. We are not responsible for any reliance you place on such information.
• Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall Quizi AI or its developer be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Account Termination

• Termination by You: You may terminate your account at any time by contacting us via email at help@quiziai.com. Upon termination, your personal account data will be permanently deleted as per our Privacy Policy.
• Termination by Quizi AI: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Reasons for termination include, but are not limited to, uploading or submitting illegal, harmful, explicit, or infringing content, or engaging in any other conduct deemed inappropriate or harmful to the Service or its users.

9. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall first be attempted to be resolved informally through good faith discussions between you and Quizi AI. If a resolution cannot be reached through informal means, any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in India.
